TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the TESSERA mobile application ("App") and related services ("Services") provided by Kelthos Inc. ("Company," "we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms.

1. ELIGIBILITY

You must be at least 13 years old to use TESSERA. If you are under 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements. Users under 13 are prohibited from creating accounts or using the Services.

2. ACCOUNTS

2.1 Account Creation

You may use TESSERA as a guest or create a registered account with email, display name, and password. You are responsible for maintaining the confidentiality of your account credentials. You must not share your account with others.

2.2 Account Security

You are responsible for all activity on your account. Notify us immediately if you suspect unauthorized access. We are not liable for losses due to unauthorized account use.

2.3 Account Termination

You may delete your account at any time via the account deletion page or in-app settings. We may suspend or terminate accounts that violate these Terms.

3. GAME RULES AND FAIR PLAY

3.1 Prohibited Conduct

You agree not to:

• Use cheats, exploits, automation, bots, or modified clients
• Reverse-engineer, decompile, or tamper with the App or its native libraries
• Manipulate game state, scores, leaderboards, or PvP matches
• Create multiple accounts to exploit referral or reward systems
• Use VPNs or proxies to circumvent geographic restrictions or rate limits
• Harass, abuse, or send offensive messages to other players
• Attempt to exploit bugs or glitches for unfair advantage (report them instead)
• Sell, trade, or transfer accounts or in-game items outside the App

3.2 Anti-Cheat

We use server-side move validation, statistical anomaly detection, device attestation (Google Play Integrity API), and replay auditing to detect cheating. Confirmed cheaters will have accounts permanently banned, leaderboard entries removed, and TESS token balances forfeited.

4. IN-APP PURCHASES

4.1 Virtual Currency and Items

TESSERA offers virtual currencies (coins and gems) and virtual items (power-ups, tile skins) for purchase. These are licensed to you, not sold, and have no real-world value except as expressly provided (TESS tokens, see Section 7). Virtual currencies and items are non-refundable except where required by law.

4.2 Subscriptions

TESSERA PRO is a recurring subscription ($4.99/month or $39.99/year). Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Manage subscriptions through Google Play. Refunds for subscriptions are handled by Google Play per their policies.

5. ADVERTISEMENTS

The free version of TESSERA displays advertisements via Google AdMob, including rewarded video ads (user-initiated) and interstitial ads (between levels). By using the free version, you consent to the display of advertisements. TESSERA PRO subscribers do not see interstitial ads.

6. PVP AND TOURNAMENTS

PvP matches and tournaments are skill-based competitions. Entry fees (virtual currency) and prizes are governed by tournament-specific rules. We reserve the right to disqualify players who violate fair play rules and forfeit their prizes.

7. TESS TOKEN AND BLOCKCHAIN

7.1 Token Nature

TESS is a utility token on the Polygon blockchain (ERC-20). TESS tokens are earned through in-game mining and have utility within the TESSERA ecosystem. TESS tokens are not securities, investments, or guaranteed to have value.

7.2 Mining

Mining is a server-side process activated by playing the game. Mining rates, requirements, and availability may change at our discretion. We do not guarantee any specific mining rewards or token value.

7.3 Withdrawals

Token withdrawals require KYC verification, a minimum balance of 100 TESS, and a 30-day account age. Withdrawal fees apply. We may suspend withdrawals for security or regulatory reasons. See Token Disclosure for full details.

7.4 NFTs

NFT tile skins are ERC-721 tokens on Polygon. Ownership is recorded on-chain. We do not guarantee the value or liquidity of NFTs. NFT marketplace fees may apply.

8. ANNUAL CHALLENGE ($5,000)

The TESSERA Grandmaster Challenge is a skill-based achievement with a $5,000 prize. Full rules are available at Challenge Rules. This is not a lottery or game of chance. Qualification requires sustained skill-based gameplay over an extended period. We reserve the right to modify or cancel the challenge if manipulation is detected.

9. INTELLECTUAL PROPERTY

All content in TESSERA, including code, art, music, sound effects, game design, and branding, is owned by Kelthos Inc. or licensed to us. You may not copy, modify, distribute, or create derivative works without our written permission. User-generated content (display names, chat messages) remains your property but you grant us a license to display it within the Services.

10. DISCLAIMER OF WARRANTIES

THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE VALUE OF TESS TOKENS OR NFTS.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KELTHOS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR VIRTUAL CURRENCY, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Kelthos Inc. from claims, damages, and expenses arising from your violation of these Terms, your use of the App, or your infringement of any third-party rights.

13. GOVERNING LAW

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Disputes will be resolved through binding arbitration under the rules of the American Arbitration Association, except where prohibited by law.

14. CHANGES TO TERMS

We may update these Terms at any time. Material changes will be communicated via in-app notification. Continued use of the App after changes constitutes acceptance.
